These Terms & Conditions govern use of modenamobilia.com and purchases from Modena Mobilia through our website, standard checkout, express checkout, telephone, email, or another authorized ordering method.
Use of this website is subject to these Terms & Conditions where applicable. By placing an order through our standard checkout, express checkout, telephone, email, or another authorized ordering method, you agree to the Terms & Conditions presented in connection with the purchase and the Modena Mobilia policies incorporated into them, including our Returns Policy, Shipping Charges, Delivery Information, Limited Warranty, and Privacy Policy.
1. Products and Natural Wood Variations
Modena Mobilia specializes in handcrafted furniture with a primary focus on solid walnut.
Natural wood varies from piece to piece. Differences in grain, color, tone, figuring, knots, mineral streaks, small checks, joint lines, and other organic characteristics are inherent characteristics of natural wood and contribute to the individuality of each piece.
Wood can also change naturally over time in response to light, humidity, temperature, and the environment in which it is placed. These normal natural characteristics and changes are not, by themselves, manufacturing defects.
Because furniture is handcrafted, minor variations in dimensions, construction details, finish, texture, or appearance may occur.
2. Product Images, Colors and Measurements
We make reasonable efforts to display our merchandise accurately.
Actual colors and finishes may vary because of screen settings, photography, lighting conditions, and natural variations in wood.
Product photographs represent the general design and appearance of merchandise but do not guarantee the exact grain pattern, coloration, figuring, or other natural characteristics of the particular piece delivered.
Dimensions are provided as accurately as reasonably possible. Minor dimensional variations may occur in handcrafted furniture.
Customers are responsible for reviewing dimensions before ordering and confirming that furniture will fit through doors, entrances, hallways, stairways, elevators, gates, and other access points and within the intended space.
3. Pricing, Specifications and Availability
Prices, specifications, product descriptions, availability, promotions, and shipping charges may change before an order is accepted.
Modena Mobilia makes reasonable efforts to provide accurate information. If an obvious pricing, description, configuration, technical, or typographical error occurs, we may correct it before fulfillment to the extent permitted by law.
If a material error affects an order already submitted, we will contact the customer and, where appropriate, offer the opportunity to proceed with the corrected order or cancel it for a refund.
4. Orders and Order Acceptance
Submission of an order does not necessarily constitute final acceptance by Modena Mobilia.
Orders may be reviewed for product availability, payment authorization, suspected fraud, shipping eligibility, pricing or technical errors, unusual quantities, or other legitimate business reasons.
An automated order acknowledgment confirms receipt of an order but does not necessarily mean the order has entered production or been finally accepted.
Modena Mobilia may decline or cancel an order when reasonably necessary and permitted by law.
If Modena Mobilia cancels an order after collecting payment and before providing the merchandise, the applicable payment will be refunded.
5. Payment and Express Checkout
Available payment methods may include credit or debit cards, PayPal, Pay Later, Google Pay, Apple Pay, and other supported payment services. Available payment methods may change.
By placing an order, the customer authorizes Modena Mobilia and its payment processors to collect or authorize the amount disclosed in connection with the transaction, including merchandise, applicable taxes, shipping, and other disclosed charges.
Third-party payment providers may impose their own eligibility requirements, financing terms, privacy policies, or contractual conditions.
Using PayPal, Pay Later, Google Pay, Apple Pay, or another express-payment service does not alter these Terms or Modena Mobilia’s applicable shipping, return, delivery, and warranty policies.
Completion of a purchase through standard or express checkout constitutes acceptance of these Terms & Conditions and the incorporated policies to the extent permitted by applicable law.
6. Sales Tax
Applicable sales tax will be collected where required. Taxes associated with qualifying refunded merchandise will be handled according to applicable law.
7. Shipping Charges
Modena Mobilia uses a weight-based flat-rate shipping system for qualifying standard orders.
The shipping tier is determined by the combined shipping weight of merchandise in the order, including applicable allowances for protective packaging and freight-handling materials.
Current rates, weight tiers, services included, and other details are stated in the Modena Mobilia Shipping Charges policy.
When multiple eligible products are purchased in the same order, their applicable shipping weights are combined to determine the shipping tier rather than charging a separate standard shipping fee for each item.
The applicable shipping charge is displayed as part of the purchase process and included in the order total. The standard shipping program is available only within the contiguous United States. Modena Mobilia does not currently offer standard shipping to Alaska, Hawaii, U.S. territories, Canada, or other international destinations.
8. Production, Shipping and Delivery Timeframes
Production time, shipment time, carrier transit time, and final delivery time are separate periods.
Any production or lead-time estimate is an estimate unless Modena Mobilia expressly guarantees a specific date in writing.
Special Orders typically require approximately 6–8 weeks of production, depending on design, materials, complexity, production capacity, and availability. This is a production estimate rather than a guaranteed delivery date.
When Modena Mobilia provides a shipment timeframe, we will make reasonable efforts to ship within that timeframe.
If we determine that merchandise cannot be shipped within an applicable promised timeframe, the customer will be informed and provided the applicable choice to consent to the delay or cancel for a refund as required by law.
Carrier delays after merchandise has been transferred to the carrier may occur for reasons outside Modena Mobilia’s direct control.
9. Delivery and Customer Responsibilities
Customers must provide complete and accurate delivery information.
An individual age 18 or older must be available to accept an attended furniture delivery.
The customer is responsible for confirming before purchase that merchandise will fit through all entrances, doors, hallways, stairways, elevators, corridors, gates, and other access points and will fit within the intended space.
Costs resulting from incorrect measurements, inadequate access, refusal of conforming merchandise, redelivery, or another customer-caused delivery issue are subject to the Returns Policy and Delivery Information policy.
10. Inspection and Transit Damage
Customers should inspect merchandise promptly upon delivery.
Visible packaging or merchandise damage should be documented and noted with the carrier whenever reasonably possible.
Customers should photograph apparent damage and promptly contact Modena Mobilia so that the matter can be evaluated and, where appropriate, a freight or insurance claim can be initiated.
Nothing in this section eliminates consumer rights that cannot legally be waived.
11. Returns and Refunds
Eligible standard merchandise may be returned subject to the Modena Mobilia Returns Policy.
A customer requesting a standard return must contact Modena Mobilia within 14 calendar days after delivery.
Eligible returns for reasons other than qualifying damage or manufacturing defect are subject to a 10% restocking fee.
Original shipping and delivery charges are nonrefundable except when otherwise provided in our policies or required by law.
A standard item returned because it does not fit through the customer’s property or does not fit in the intended space is eligible, if otherwise returnable, for store credit rather than a cash, card, or original-payment-method refund, less the applicable original shipping or delivery charge and restocking fee.
The Returns Policy contains the complete eligibility requirements, exclusions, procedures, and refund terms and is incorporated into these Terms.
12. Special Orders and Custom Furniture
A Special Order includes merchandise made, sized, configured, upholstered, modified, or otherwise produced specifically according to customer-approved specifications.
Before production begins, relevant specifications may include dimensions, materials, upholstery, proportions, design details, configuration, and price.
Customers are responsible for carefully reviewing all specifications before approval and for the accuracy of measurements they provide.
Once final specifications are approved and production has begun, the Special Order is noncancelable and nonreturnable, except where the merchandise arrives damaged; a qualifying manufacturing defect exists; the merchandise materially fails to conform to the customer-approved specifications; Modena Mobilia agrees otherwise in writing; or applicable law requires a remedy.
Natural walnut grain, coloration, figuring, knots, tonal variation, and other normal natural-wood characteristics do not constitute a failure to conform to approved specifications unless a particular characteristic was expressly guaranteed in writing.
Customer-approved written specifications control the dimensions and configuration of a Special Order. Any specific written terms contained in an approved Special Order quote or confirmation supplement these Terms.
13. Limited Warranty
Qualifying merchandise is covered by the Modena Mobilia Limited Warranty applicable to the product.
The Limited Warranty states the applicable warranty periods, covered defects, exclusions, and remedies.
Normal wear, accidents, misuse, improper care or storage, unauthorized alteration, environmental damage, and normal characteristics of natural materials are not manufacturing defects except to the extent applicable law provides otherwise.
Nothing in these Terms or in the Limited Warranty eliminates or restricts warranty or consumer rights that cannot legally be waived.
14. Care of Solid Wood Furniture
Solid wood responds naturally to environmental conditions.
Furniture should be protected from prolonged excessive moisture, extreme dryness, direct heat, extreme temperature fluctuations, and other conditions capable of damaging natural wood.
Expansion, contraction, minor movement, and changes in color or appearance may occur naturally.
Warranty coverage may not apply where damage results from improper care, storage, use, or environmental exposure.
15. Intellectual Property
Unless otherwise stated, original Modena Mobilia text, product descriptions, photography, graphics, logos, branding, designs, and other original website content are owned by or licensed to Modena Mobilia and protected by applicable law.
Website content may be used for lawful personal shopping purposes.
Unauthorized commercial reproduction, republication, distribution, or exploitation of protected Modena Mobilia content is prohibited except as permitted by law.
Customer-submitted photographs, sketches, links, or reference materials may be used to communicate Special Order preferences. Providing a reference design does not mean Modena Mobilia will reproduce another designer’s protected work exactly.
16. Prohibited Use
The website may not be used for fraud, unauthorized access, security interference, malicious code, impersonation, false payment information, unlawful activity, or abuse of the website or its systems.
Modena Mobilia may restrict access or decline transactions associated with reasonably suspected fraud, security threats, or unlawful activity.
17. Third-Party Services
Modena Mobilia may use third-party payment processors, financing services, carriers, technology providers, analytics services, or other independent services.
Third parties may maintain separate terms and privacy policies.
Modena Mobilia is not responsible for independently operated third-party services except to the extent applicable law provides otherwise.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Modena Mobilia is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of the website or a transaction when such liability may lawfully be limited.
Nothing in these Terms limits liability, remedies, warranties, or consumer rights that cannot legally be limited.
Nothing in this provision alters Modena Mobilia’s obligations regarding qualifying defects, warranties, shipment obligations, refunds, or other remedies required by law.
19. Privacy
Personal information is handled according to the Modena Mobilia Privacy Policy.
Third-party payment providers may separately process information under their own privacy policies.
20. Governing Law
These Terms and transactions with Modena Mobilia are governed by applicable federal law and, where applicable, California law.
Nothing in these Terms is intended to deprive a consumer of rights or remedies available under applicable consumer-protection law.
21. Severability
If a provision is determined to be invalid or unenforceable, it will be enforced to the maximum lawful extent or severed where necessary without invalidating the remaining provisions.
22. No Waiver
Failure to enforce a provision on one occasion does not permanently waive the right to enforce it later.
23. Changes to These Terms
Modena Mobilia may revise these Terms from time to time.
The version applicable to an order will generally be the version in effect when the order was placed, except where a later change is required by law or expressly agreed to by the customer.
The latest revision date appears at the beginning of these Terms.
